All employers that employ at least 50 full-time employees, including FTEs, are subject to the ACA’s employer shared responsibility rules, including for-profit, nonprofit and government employers.
A full-time employee is an individual who works, on average, 30 or more hours per week. For this purpose, 130 hours in a calendar month is treated as the monthly equivalent of 30 hours of service per week, according to the IRS.
Minimum essential health insurance coverage must provide minimum value and be affordable to full-time employees.
If your business meets this threshold, you typically must offer the following:
- Health insurance that meets IRS criteria for affordability
- Coverage that meets minimum essential coverage standards
- A plan that meets minimum value requirements
- Coverage for at least 95% of full-time employees and their dependents
A plan is considered affordable if the employee’s share of the premium for the lowest-cost self-only plan does not exceed 9.5% of their household income. This percentage adjusts slightly each year.
A plan must cover at least 60% of the total allowed cost of benefits expected to be incurred under the plan.
What If You Have Fewer Than 50 Employees?
If your business has fewer than 50 full-time or FTE employees, you are not required to offer group health insurance under the ACA.
